This Privacy Policy explains how 91 Branding & Marketing Pte. Ltd. (UEN 201630804Z), trading as “NinetyOne” (“NinetyOne“, “we”, “us”, or “our”), collects, uses, discloses, and protects your personal data when you visit https://ninetyone.sg (the “Website“), contact us, or engage our communications services.
We are committed to handling personal data responsibly and in accordance with Singapore’s Personal Data Protection Act 2012 (the “PDPA“).
1. Who we are
NinetyOne is the trading name of 91 Branding & Marketing Pte. Ltd. (UEN 201630804Z), a Singapore-based communications agency. We are the organisation responsible for the personal data described in this Policy.
2. The personal data we collect
We collect personal data that you provide to us directly, and certain data automatically when you use the Website.
2.1 Information you provide to us
- Enquiry / contact form: when you complete the contact form on the Website, we collect your name, organisation, email address, telephone number, and the contents of your message.
- Correspondence and engagements: when you contact us by email, WhatsApp, telephone, or social media, or when you engage us for services, we collect your contact details, business information, and any personal data contained in those communications or in materials you provide.
2.2 Information we collect automatically
- Technical and usage data: your IP address, browser type and version, device and operating system, referring website, the pages you view, and the date and time of access — collected through server logs and the cookies and similar technologies described in Section 5.
We do not intentionally collect special or sensitive categories of personal data through the Website, and we do not knowingly collect personal data from children. Please do not submit such information unless it is necessary for an engagement.
3. How we use your personal data
We collect, use, and disclose your personal data for the following purposes:
- to respond to your enquiries and provide the information or materials you request;
- to provide, manage, and deliver our services and to perform our contractual obligations to you or your organisation;
- to communicate with you about engagements, including administrative and service-related messages;
- to operate, maintain, secure, and improve the Website — including preventing spam and automated abuse of our forms;
- to comply with applicable laws, regulations, and lawful requests by public authorities; and
- where you have consented, to send you marketing communications or newsletters (you may opt out at any time).
4. Consent and withdrawing consent
By submitting your personal data to us, you consent to our collection, use, and disclosure of that personal data for the purposes set out in this Policy. If we intend to use your personal data for a new purpose, we will obtain your consent where required by law.
You may withdraw your consent at any time by contacting our Data Protection Officer (Section 11). On receiving your request, we will inform you of the likely consequences of withdrawal and will cease the relevant processing within a reasonable time. Withdrawing consent does not affect the lawfulness of any processing carried out before the withdrawal, and may mean we are unable to continue providing certain services to you.
5. Cookies and similar technologies
The Website uses a limited number of cookies and similar technologies:
- Strictly necessary and functional: required for core site functions, security, and performance/caching.
- Security (Google reCAPTCHA v3): we use Google reCAPTCHA on our forms to protect against spam and automated abuse. reCAPTCHA may set cookies and collect device and usage information, which is processed by Google under Google’s Privacy Policy and Terms of Service.
- Analytics and performance: we use VisibilityKit to understand how our content is discovered and how it performs. This service may collect technical and usage data as described in Section 2.2.
- Web fonts: we load Google Fonts to display the Website’s typography, which may transmit your IP address to Google.
You can manage or disable cookies through your browser settings. Disabling certain cookies may affect how the Website functions.
6. Disclosure of your personal data
We do not sell your personal data. We may disclose your personal data to:
- Service providers and data intermediaries who process personal data on our behalf under appropriate confidentiality and data-protection obligations — including our website hosting provider (GoCloudEasy), email-delivery (SMTP) providers, Google (reCAPTCHA and Fonts), and our analytics provider (VisibilityKit);
- Professional advisers such as auditors, lawyers, and accountants;
- Authorities and regulators where required or permitted by law, or to protect our rights, safety, or property; and
- a successor entity in connection with a merger, acquisition, financing, or reorganisation of our business.
7. Transfers of personal data outside Singapore
Some of our service providers (for example, Google) may store or process personal data on servers located outside Singapore, including in the United States. Where we transfer personal data outside Singapore, we comply with the PDPA’s Transfer Limitation Obligation and take reasonable steps to ensure the recipient provides a standard of protection comparable to that under the PDPA.
8. Protection and retention of your personal data
We implement reasonable administrative, technical, and physical safeguards to protect personal data against unauthorised access, use, disclosure, alteration, or loss — including encryption in transit (HTTPS), access controls, restricted and protected administrative access, and bot/spam protection. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.
We retain personal data only for as long as necessary to fulfil the purposes set out in this Policy, or as required by applicable law. Enquiry and contact-form submissions are generally retained for up to 24 months unless they lead to an engagement; records relating to an engagement are retained for the duration of the engagement and for a reasonable period afterwards to meet our legal, accounting, and regulatory obligations. We will cease to retain personal data, or remove the means by which it can be associated with you, when retention is no longer necessary for legal or business purposes.
9. Keeping your personal data accurate
We rely on you to ensure that the personal data you provide is accurate and complete. Please notify us promptly of any changes so that we can update our records.
10. Your rights
You have the right to request access to the personal data we hold about you, and information about the ways in which it has been used or disclosed during the past year, and to request correction of any error or omission in your personal data. You may also withdraw your consent to our continued collection, use, or disclosure of your personal data at any time. We may charge a reasonable fee for an access request, as permitted under the PDPA, and will inform you of any such fee in advance. To exercise any of these rights, please contact our Data Protection Officer (Section 11).
